A. Customer & User Data

When you register, subscribe, or communicate with us, we collect:

• Billing & Transaction Data: Records of subscriptions and payments. Note: All payments are processed by our Merchant of Record (MoR), either Armitage Labs OÜ (Creem) or Dodo Payments Inc. We do not store full credit card numbers on our own servers.

B. Demand Intelligence Data (Public Discourse)

Our AI-powered engine analyzes Publicly Available Information (PAI) from digital communities to identify customer intent.

• Scope: We only process discussions and intent signals intended by the original posters for public viewing.
• Limitations: We do not collect personal data from private profiles, password-protected areas, or non-public databases.

3. Legal Basis for Processing

We process data under the following GDPR legal frameworks:

• Contractual Necessity: To provide the SaaS dashboard, Opportunity Inbox, and license keys you purchased.
• Legitimate Interest: To synthesize market insights and demand signals from public digital communities for professional market research.
• Legal Obligation: To maintain financial and tax records as required by the Malta Tax and Customs Administration.

4. Operational Compliance Standards

As per our core platform standards, AgenticAir operates with strict ethical and technical safeguards:

• Not a Marketing Automation Tool: We do not facilitate mass automated outreach or spam.
• Protocol Adherence: We strictly adhere to robots.txt protocols and do not circumvent technical safeguards.
• Human-in-the-Loop (HITL): AgenticAir is a decision-support tool. No actions, engagements, or outreach are ever taken on a user's behalf without explicit manual review and approval by a human user.

5. Data Sharing and Merchant of Record

We share data only with essential service providers necessary for global operations:

• Merchant of Record (MoR): Payments are processed by Armitage Labs OÜ (Creem) or Dodo Payments Inc. The MoR is the legal seller of the product and handles all global tax collection, invoicing, and local compliance.
• Infrastructure: Trusted cloud hosting and AI model providers necessary to run the Demand Intelligence engine.

6. Data Retention

We retain your personal data for as long as your account is active. For compliance with Maltese tax law and anti-money laundering (AML) regulations, transaction data and identifying documents may be retained for up to 10 years.

7. Your Rights (GDPR)

Users in the European Economic Area (EEA) hold the following rights:

• Access and Portability: Request a copy of your personal data.
