1. Legal Agreement and Identity

The Service is provided and operated by Asemota Ize-Iyamu, a self-employed individual residing in Malta (trading as AgenticAir). By accessing our Service, you agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

AgenticAir is an AI-powered Demand Intelligence platform that identifies real-time market signals and customer intent within public digital communities.

Core Operational Standards:

• Decision Support: The Service is a decision-support tool. It does not perform automated outreach or engagement.
• Human-in-the-Loop (HITL): No actions are ever taken on a user's behalf without explicit manual review and approval by the user.
• Public Data Utilization: Our AI only analyzes discussions intended by the original poster for public viewing and strictly adheres to standard community protocols (e.g., robots.txt).

3. Merchant of Record (Payments)

You acknowledge that AgenticAir utilizes a Merchant of Record (MoR) model for global commerce. When you purchase a subscription or license, the transaction is executed by our authorized reseller:

• Contractual Seller: The legal seller of the product and the entity that will appear on your bank statement is either Armitage Labs OÜ (Creem) or Dodo Payments Inc.
• Tax Compliance: The MoR is responsible for all global tax collection (VAT/GST), remittance, and invoicing. By completing a purchase, you agree to the MoR's respective Buyer Terms.

4. User Accounts and Subscriptions

• Eligibility: You must be at least 18 years old to use this Service.
• Access: Access is granted via License Keys or automated provisioning upon successful payment. Keys are limited to one (1) user per account unless otherwise stated.
• Cancellations: Subscriptions can be managed or cancelled at any time through the Creem/Dodo Customer Portal.

5. Acceptable Use

You agree not to use the Service to:

• Attempt to bypass technical safeguards or access private data.
• Facilitate "spam" or mass automated outreach.
• Infringe upon the intellectual property rights of others.
• Engage in any activity that violates the terms of the digital communities analyzed by the Service.

6. Disclaimer of Warranties

AgenticAir provides synthesized market intelligence "as-is." We do not guarantee the accuracy of AI-generated insights or the conversion rate of any demand signals. You are solely responsible for any actions you take based on the intelligence provided by the platform.

7. Limitation of Liability

To the maximum extent permitted by Maltese and EU law, Asemota Ize-Iyamu (trading as AgenticAir) shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Service.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of Malta. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the Maltese courts.
